Gandhi, Rahul: A Congress leader in India was imprisoned for calling Modi's remarks "thieves."


In a criminal defamation case, opposition leader Rahul Gandhi was given a sentence of two years in prison.


During an election rally in 2019, Mr. Gandhi made remarks about Prime Minister Narendra Modi's surname. The court in Gujarat state found him guilty.

He won't go to jail right away because he was granted bail for 30 days and plans to appeal the verdict.

The Congress Party MP attended the sentencing, which took place a year before the general elections.

In advance of the most recent general election, in April 2019, Mr. Gandhi made the following remarks at an election rally in the state of Karnataka: Why do all of these thieves go by the name Modi? Lalit Modi, Narendra Modi, and Nirav ModiNirav Modi is an Indian diamond tycoon who is currently on the run, while Lalit Modi is a former chief of the Indian Premier League who has been handed a lifetime ban by the country's cricket board. Mr. Gandhi argued that he had made the remark to draw attention to corruption and not to target any particular community.

Purnesh Modi, a member of India's ruling Bharatiya Janata Party, filed the complaint that led to the filing of the case against him. Purnesh Modi claimed that Mr. Gandhi's remarks had slammed the entire Modi community.

However, some have stated that the order has them baffled.

"References to a generic class of persons," as in surnames in this instance, are not "actionable unless an individual can show a direct reference to themselves," according to legal scholar Gautam Bhatia's tweet.

Mr. Bhatia stated, "If a man says 'all lawyers are thieves,' then I, as a lawyer, cannot file a case against him for defamation unless I can show that it was directed at me."

The criminal defamation law in India is British-era legislation with a maximum sentence of two years in prison, a fine, or both.

Advocates for free speech have frequently argued that the law violates freedom principles and is utilized by politicians to silence critics.

Defamation should no longer be a criminal offense, according to legal filings made in 2016 by prominent Indian politicians, including Mr. Gandhi. Yet, India's High Court maintained the legitimacy of the law, saying that the "right to free discourse can't imply that a resident can stigmatize the other".

"We will fight and win," Mr. Gandhi tweeted, indicating that the Congress party would file an appeal.

While Mr. Gandhi has not yet made a public statement, he has tweeted a quote from India's independence hero Mahatma Gandhi: Truth and nonviolence are the foundations of my religion. My God is the truth, and nonviolence is the way to get it."
His attorney, Kirit Panwala, told BBC Gujarati that Mr Gandhi had told the appointed authority after the request that he had delivered the discourse "for a majority rules system".

Additionally, he stated that their argument in favor of Mr. Gandhi rested on four points: First, an investigation ought to be carried out prior to the complaint because Mr. Gandhi does not reside in Gujarat. Second, there is no Modi community. Thirdly, no one is associated with Modi by name, and fourthly, Mr. Gandhi's speech was not motivated by malice.

Some have brought up issues over Mr Gandhi's status as an individual from parliament after the conviction.
